Welcome to the Terms of Use of Our website, www.trademalta.org (the “Website”). This Website is owned and managed by Trade Malta Limited, a private limited liability company registered under the laws of Malta, having company registration number C-67993 and its registered address situated at The Clock Tower, Level 1, Tigne Point, Sliema TP01, Malta (“TradeMalta”, the “Company”, “We”, “Us”, or “Our”).
TradeMalta is a public-private partnership with the Government of Malta, currently under the remit of the Ministry for Foreign and European Affairs and Trade, and the Malta Chamber of Commerce, Enterprise and Industry.
Accordingly, TradeMalta is dedicated to help Malta-based businesses to go international and provides the following services to individuals and legal persons, such as companies:
- Financial Support: TradeMalta offers financial assistance to eligible businesses through the International Trade Promotion Incentive Scheme. Detailed guidelines for this scheme are provided in the attached document.
- Trade Information Services: TradeMalta supports companies with market research by providing market data, information, analysis, and reports. Additionally, businesses receive free access to advanced market analysis tools.
- Capacity Building: TradeMalta delivers specialized training programmes, webinars, podcasts, and online courses, all designed to enhance the skills and knowledge necessary for successful international trade.
- Trade Promotion: To help businesses expand their reach, TradeMalta organizes business missions, participates in international expos, and hosts networking events. Furthermore, provides a comprehensive platform connecting local companies to potential business partners.
Collectively, the abovementioned services, along with any other services that may be determined as relevant to the particular client, shall hereafter be referred to as the “TradeMalta Services”.
General Terms of Use
The provisions of these Terms of Use govern the entry, access, connection to or use of Our Website by any users(the “user/s”, “you”, or “yours”).
For the avoidance of doubt, any reference in these Terms of Use, the term to ‘use’ shall refer to any sort of use of the Website, inclusive of simple entry, access or connection to the same Website. These Terms of Use form a legally binding agreement between Us and the user, and therefore you should take the time to read them carefully. By entering, accessing, connecting to or using this Website in any manner, you are deemed to have read, understood and agreed to these Terms of Use.

Intellectual Property
For the purposes of this section ‘Intellectual Property’ shall include, without limitation, and whether registered, unregistered or registerable in Malta or elsewhere, any trademark, tradename, logo, design, mark, industrial design, copyright or copyrightable material, patent, internet domain name, website address, mask work, trade secret, knowhow, technical data, market data, method or specification.
Any and all Intellectual Property related in any manner whatsoever to the Website, or to TradeMalta Services is the sole and exclusive property of TradeMalta and is subject to protection under the applicable law.

Since one of the purposes of the Website is to promote Malta-based companies abroad, TradeMalta may accept requests to reproduce data from the Website, subject to the conditions imposed by TradeMalta, including that the material does not infringe on the rights or privacy of third parties. (viii) non-performance by suppliers or subcontractors;
(ix) interruption or failure of utility service;
(x) theft;
(xi) hacking attacks;
(xii) mechanical or systems failures; and
(xiii) downtime of the Website or reduced service availability of the same.

No exercise or failure to exercise or delay in exercising any right or remedy available to TradeMalta under these Terms of Use will constitute a waiver by TradeMalta of that or any other right or remedy available to it.

In the event that any provision, or part thereof, of these Terms of Use is found by a competent adjudicatory body or court of law to be invalid, unlawful or unenforceable to any extent, then such provision, or part thereof, shall be severed from the remainder of these Terms of Use, which shall continue to be valid and enforceable to the fullest extent permitted by law.
Governing Law and Jurisdiction
These Terms of Use shall be governed by the Laws of Malta. Any disputes which may arise between yourself and TradeMalta in relation to these Terms of Use shall be subject to the exclusive jurisdiction of the Maltese Courts.
Data Protection
You acknowledge that We may process personal data in relation to you (if you are an individual) and personal data that you may provide to Us in relation to your employees or associates or other individuals (if you are a legal person, such as a company) in connection with these Terms of Use and your use of the Website, or any of TradeMalta’s Services.
We shall process this personal data in strict compliance with all data protection and data privacy laws, particularly Regulation (EU) 2016/679 (the General Data Protection Regulation), and in accordance with Our Privacy Policy.
Information about financial assistance
Any information concerning financial assistance and rules or regulations pertaining to schemes to support businesses, is intended as a guideline only and they cannot be interpreted to constitute a right to assistance by any users. The decision to provide financial assistance will always be taken by the competent boards or committees within TradeMalta, even if this should be in contradiction of the guidelines and instructions disseminated on this Website.
